01Acceptance of Terms
By accessing and using the Brookshire Living website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, you should not use our website or services. These terms apply to all visitors, users, and others who access or use the service.
02Description of Service
Brookshire Living is a tenant liaison service. We are not a property management company, landlord, or real estate broker. We act as an intermediary between prospective tenants and property owners or management companies, assisting with property discovery, application facilitation, and move-in incentive coordination. We do not own, manage, or lease any properties listed on our platform.
03Application Fees
A flat application fee of $55 per adult applicant, per property applied for is required to process each rental application. This fee is non-refundable for non-approved applicants. Upon approval, the $55 application fee is applied as a credit toward your first month's rent, in addition to any applicable move-in incentives. We do not charge administration fees or hidden processing charges. Payments are processed securely through our payment provider.
04Application Accuracy
You are responsible for providing accurate, truthful, and complete information on your rental application. By submitting an application, you acknowledge that all information provided is correct to the best of your knowledge. Providing false or misleading information may result in immediate denial of your application and forfeiture of any fees paid. You authorize Brookshire Living to verify all information provided, including conducting credit and background checks with your consent.
05No Guarantee of Approval
Submission of a rental application and payment of the application fee does not guarantee approval. Approval decisions are made by the property owner or management company, not by Brookshire Living. We facilitate the application process but do not have authority over approval decisions. If your application is denied, the application fee is non-refundable.
06Move-In Incentives
Move-in incentives, including the graduated rent credit program and security deposit coverage promotions, are available for approved applicants and may vary by participating property and availability. Incentives are offered for a limited time and are subject to change without notice. Brookshire Living reserves the right to modify, suspend, or discontinue any incentive program at any time. Pet deposits are not included in any deposit coverage promotions.
07Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of Brookshire Living or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.
08Limitation of Liability
Brookshire Living shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of our services. Our total liability for any claim arising from these terms or your use of our services shall not exceed the amount you have paid us in application fees in the preceding six months.
09Indemnification
You agree to indemnify and hold harmless Brookshire Living, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the service, your violation of these terms, or your violation of any rights of a third party.
10Changes to Terms
We reserve the right to modify these Terms of Service at any time. If we make material changes, we will notify you by email or by posting a notice on our website. Your continued use of the service after any changes constitutes acceptance of the updated terms.
11Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in Houston, Texas.
